The Commission has the authority to impose fines, suspend or revoke licenses, and take other disciplinary measures to ensure compliance with its regulations.

    The Commission asserts that its authority to enact the Kahnawake Gaming Law derives from Kahnawake’s Mohawk or “aboriginal rights,” which have existed since time immemorial and have never been challenged under Canadian or any other law. The Commission currently issues licenses to more than 50 online gaming operators, representing an estimated 250 online gaming sites.

    In the past, the Commission has taken regulatory action, such as during the 2009 Ultimate Bet cheating scandal, where cheating occurred on the Ultimate Bet poker site, and the Commission imposed a number of sanctions on Ultimate Bet’s ownership, including a refund of approximately $22,000,000 to players and a fine of $1,500,000.

    Notably, the New Jersey Division of Gaming Enforcement announced in 2016 that the KGC would no longer issue licenses to gambling operators who accept U.S. clients. The Kahnawake Gaming Commission operates under a different legal framework and jurisdiction than Malta’s gaming license and regulations, but both regulatory bodies share the same objective of ensuring a safe and fair online gambling industry.

    The KGC has a lengthy history of providing effective regulatory oversight. According to the Commission’s 2020 annual report, its jurisdiction encompassed 86 active licenses representing 53 operators and 289 domains. These licensees generated $1.58 billion in total gaming revenue, the majority of which came from online casino gaming.

    The KGC is also committed to promoting responsible gambling and has implemented a variety of safeguards, such as age verification and self-exclusion tools, to protect players. The Commission requires its licensees to prominently display information about responsible gaming on their websites and to offer assistance to players who may be experiencing gambling problems.

    The KGC is governed by laws and regulations derived from the Mohawk Council of Kahnawake’s Gaming Law, which was enacted for the first time in 1996. The legality of this law and the activities of the KGC have never been contested under Canadian or international law.
